องค์กรเครือข่ายผู้บริโภคแสดงจุดยืน ยื่น 4 ข้อเสนอให้รักษาการ กสทช.ให้เดินหน้าคุ้มครองผู้บริโภคต่อ ด้าน สบท.ระบุยังทำงานต่อถึงแม้พ.ร.บ.ใหม่บังคับใช้ สนับสนุนตั้งหน่วยงานคุ้มครองผู้บริโภคกล้องวงจรปิดหน่วยงานเดียวดีกว่า เพียงแต่ต้องเพิ่มผู้เชี่ยวชาญวิชาชีพเข้าดูแลกิจการวิทยุโทรทัศน์d
นายสวัสดิ์ คำฟู ตัวแทนองค์กรเครือข่ายผู้บริโภคทั่วประเทศ กล่าวว่า หลังจากพระราชบัญญัติองค์กรจัดสรรคลื่นความถี่และกำกับการประกอบกิจการวิทยุ กระจายเสียง วิทยุโทรทัศน์และกิจการโทรคมนาคม มีผลบังคับใช้เมื่อวันที่ 20 ธ.ค.ที่ผ่านมา ส่งผลให้สถานภาพของสำนักงานคณะกรรมการกิจการโทรคมนาคมแห่งชาติ (สกทช.) หมดสภาพลง และต้องปรับเปลี่ยนเป็นสำนักงานคณะกรรมการกิจการกระจายเสียง กิจการโทรทัศน์และกิจการโทรคมนาคมแห่งชาติแทน แต่คณะกรรมการกิจการโทรคมนาคมแห่งชาติ (กทช.) ยังคงมีหน้าที่รักษาการแทน กสทช. ไปก่อนจนกว่าจะมีการสรรหา กสทช. ซึ่งต้องดำเนินการให้แล้วเสร็จภายใน 180 วัน
ด้วยอำนาจหน้าที่ของ กสทช. ตามมาตรา 31 กำหนดให้ กสทช. แต่งตั้งคณะอนุกรรมการขึ้น 2 คณะทำหน้าที่คุ้มครองผู้บริโภคด้านกิจการกระจายเสียงและโทรทัศน์ และคุ้มครองผู้บริโภคในกิจการโทรคมนาคมนั้น ทาง องค์กรเครือข่ายผู้บริโภคทั่วประเทศ ขอยื่นข้อเสนอมาตรการคุ้มครองผู้บริโภคต่อรักษาการประธาน กสทช. ให้ช่วยดำเนินการตามข้อเสอนดังต่อไปนี้ ข้อแรก เร่งให้มีการคุ้มครองผู้บริโภคในด้านกิจการกระจายเสียง กิจการโทรทัศน์อย่างเร่งด่วน โดยให้คงบทบาทการคุ้มครองผู้บริโภคในกิจการโทรคมนาคมของสถาบันคุ้มครองผู้ บริโภคในกิจการโทรคมนาคม (สบท.) ต่อไป ข้อที่สอง เร่งออกมาตรการคุ้มครองสิทธิในความเป็นส่วนตัวและเสรีภาพของบุคคล อาทิ กรณีการส่งเอสเอ็มเอสรบกวน การขายสินค้าผ่านโทรศัพท์ รวมถึงกำหนดมาตรการโอนย้ายเลขหมายโดยไม่เสียค่าใช้จ่าย
ข้อที่สาม เร่งดำเนินการให้ผู้ประกอบการที่ไม่กำหนดวันหมดอายุของบัตรเติมเงินตาม ประกาศ กทช. เรื่องมาตรฐานของสัญญาการให้บริการโทรคมนาคม พ.ศ.2549 และให้มีมาตรการบังคับให้ผู้ประกอบการคืนเงินที่ยึดจากผู้บริโภคเนื่องจาก การกำหนดวันหมดอายุบัตรเติมเงิน และข้อที่สี่ ขอให้มีการดำเนินการทำตามแผนแม่บทการประกอบกิจการวิทยุกระจายเสียง วิทยุโทรทัศน์และกิจการโทรคมนาคม ให้มีความสำคัญกับการมีส่วนร่วมของทุกภาคส่วน เพื่อให้กสทช.ชุดใหม่สามารถปฎิบัติหน้าที่ได้เร็วยิ่งขึ้น
ทางด้านนางสาวสารี อ๋องสมหวัง กรรมการ เครือข่ายองค์กรผู้บริโภค กล่าวว่า ตลอด 3 ปีที่มีสบท. ซึ่งถือเป็นนวัตกรรมของที่กทช.ที่ร่วมมือกับองค์กรผู้บริโภคที่มีความอิสระ ในการทำงาน ไม่ว่าจะเป็นจากภาคธุรกิจหรือแม้กระทั่งกทช.เอง สามารถเข้ามาช่วยคุ้มครองผู้บริโภคจากการใช้บริการในกิจการโทรคมนาคมได้ หลายๆ ปัญหา
"จากวันที่ไม่มีสบท. มีเรื่องร้องเรียนเข้ามาเพียง 16 เรื่องต่อปี แต่หลังจากที่มีสบท.จำนวนเรื่องร้องเรียนในกิจการโทรคมนาคมในปี 2553 นี้มีถึง 5,000 ราย"
ขณะที่นายประวิทย์ ลี่สถาพรวงศา ผู้อำนวยการ สบท. กล่าวว่า ได้รับการยืนยันคำตอบว่าสบท.ยังดำเนินการอยู่ ไม่ได้ล้มไปหลังจากที่มีการประกาศใช้พรบ.ฉบับใหม่แต่ประการใด โดยยังคงทำงานตามภารกิจเดิมทุกประการ ในระหว่างที่ยังไม่มีการตั้งอนุกรรมการตามมาตรา 31 ออกมา สบท.สามารถยื่นเรื่องต่อกสทช.ได้โดยตรง แต่ถ้ามีอนุกรรมการเมื่อใดสบท.ก็จะยื่นเรื่องผ่านทางอนุกรรมการแทน
"วันนี้ ผมได้รับการยืนยันว่าสามารถลงนามในหนังสือต่างๆ ในนามรักษาการปฏิบัติการหน้าที่แทนเลขาธิการ กสทช. นั้นแสดงให้เห็นว่า สบท.ยังคงอยู่ ไม่ได้หมดวาระตามที่หลายคนตีความ ซึ่งกฎหมายใหม่ไม่ได้คุ้มครองผู้บริโภคน้อยลง แต่กลับมากยิ่งขึ้นกว่ากฎหมายฉบับเก่าเสียอีก"
นายประวิทย์ ยังให้ความคิดเห็นถึงการ ตั้งหน่วยงานคุ้มครองผู้บริโภคตามกฎหมายใหม่ว่า จะมีหน่วยงานเดียวหรือสองหน่วยงานก็ได้ ขึ้นอยู่กับกสทช.จะมีแนวนโยบายอย่างไร ซึ่งน่าจะเป็นหน่วยงานเดียวเนื่องจากวันนี้เทคโนโลยีกับเรื่องของการให้ บริการนั้นได้หลอมรวมเข้าด้วยกันแล้ว ซึ่งจะทำให้การทำงานนั้นสะดวกและรวดเร็วขึ้น เพียงแต่อาจจะต้องมีการแยกผู้เชี่ยวชาญออกจากกัน ซึ่งความเชี่ยวชาญทางด้านโทรคมนาคมนั้น ทางสบท. ก็มีประสบการณ์มาแล้วพอสมควร จึงไม่ค่อยมีปัญหานักในการทำงาน แต่สำหรับกิจการวิทยุโทรทัศน์นั้น ยังไม่มีหน่วยงานที่เข้ามาดูแลเลย ซึ่งมีเรื่องต่างๆ จำนวนมาก เช่น รายละเอียดของเนื้อหารายการ
"เรื่องการคุ้มครองผู้บริโภคในกิจการวิทยุโทรทัศน์นั้นจำเป็นที่จะ ต้องมีเรื่องของวิชาชีพเข้ามาสนับสนุน ซึ่งจำเป็นอย่างยิ่งที่จะต้องมีการดำเนินการในเรื่องนี้ไปพร้อมๆ กับการสรรหากสทช. ซึ่งต้องใช้เวลาพอสมควร ถ้ามาตั้งตอนที่มีกสทช.แล้ว ก็จะไม่ทันการ"
ในกรณีที่จะแยกหน่วยงานคุ้มครองฯ นั้น ก็ไม่มีปัญหาแต่ประการใด เพียงแต่จะต้องมีการทำงานที่บูรณาการเข้าด้วยกัน และจะต้องมีเกตเวย์หรือจุดจัดการเรื่องร้องเรียนเป็นจุดเดียวกัน คือ สามารถรับเรื่องร้องเรียนได้ทุกเรื่อง ผู้บริโภคไม่ต้องเสียเวลาติดต่อหน่วยงานต่างๆ ให้ยุ่งยาก
"เรื่องร้องเรียนต่างๆ จะหมดไปกว่าครึ่ง หากมีการบังคับใช้กฎหมายอย่างจริงจัง รวมไปถึงการสร้างจิตสำนึกให้กับผู้ประกอบการอีกด้วย ที่สำคัญ ผู้บริโภคเองก็จะต้องส่งสัญญาณให้ผู้ประกอบการควบคู่ไปด้วย"

นาธาน ด่าแม่บุญธรรม เล่นละคร
คุณกำลังจะบอกว่าพวกนี้สร้างบ้านขึ้นมา พอถึงเวลาประโยชน์ไม่เอื้อกับเขา เลยโยนความผิดทุกอย่างให้คุณ โดยสร้างตัวละครมา? “ถูก มีเรื่องทัวร์ มีน้ามด มีหลายอย่างที่เขาสร้างขึ้นมา ยืนยันผมไม่ได้เอาเงินเขามาครับ เป็นเรื่องที่เขาอุปโลกน์ขึ้นมาเพื่อให้ธานเสียหาย ปัญหามันมาจากเรื่องบ้าน เพราะเงินขาดไม่พอ เขาก็หยิบยืมกันเอง เขาเคยหยิบยืมเงินกันเองครับ ดังนั้นส่วนไหนที่รู้สึกว่าเสียหายปุ๊บ หรืออะไรที่แย่ เขามีลางสังหรณ์ว่าแย่ ตอนนี้เขาก็ยิงประเด็นมาที่ธานเต็มๆ ฉะนั้นขอให้ครูพิสมัยหยุดสักที ให้เอาตัวจริงออกมาสักที เพราะมันหมดละครที่ต้องเล่นแล้ว ธานเล่นให้กับครูแหม่มปีที่แล้ว 1 ปีเต็ม ฉะนั้นธานขอจบละครที่ครูแหม่มสร้างทั้งหมด”
คิดว่าที่ “ครูแหม่ม” เข้ามาเกี่ยวข้องด้วยกับชีวิตตลอด 2-3 ปีที่ผ่านมา เป็นแผนของครูแหม่มทั้งหมด? “ก็คือทั้งหมด มันแล้วแต่คนจะคิด ธานขอไม่ตอบดีกว่า ธานรู้จักกับครูแหม่มมาประมาณ 4 ปีกว่าๆ แต่ธานรู้จักพี่เต็ม (สมาน สุขเสริม) มามากกว่าเขา ฉะนั้นเขาทำให้ธานกับพี่เต็มแตกแยกกันอย่างไม่เหลือเยื่อใยเนี่ย ถามพี่เต็มได้เลยว่ามันเป็นยังไง ธานคิดว่าเขาทำให้ธานมีปัญหากับพี่เต็ม เพราะรู้สึกว่าทุกคนที่มาช่วยธานตอนนี้ แม้กระทั่งคนใกล้ตัวธานที่รู้สึกดีและปลอดภัย มันกลายเป็นพิษ เป็นดาบทิ่มข้างหลังธานตลอดเวลา ธานถูกครูแหม่มหักหลัง โดยมีตัวละครเพิ่มขึ้นมาคือน้ามด ที่โยนความผิดมาให้ธาน”
“ธานเคลียร์ปัญหานี้แน่นอน เขาไปแจ้งความแล้วมันก็ไม่ใช่เรื่องใหญ่ ถามว่าจะไปมอบตัวไหม ธานต้องไปสาธยายไปเล่าความจริงให้เขาฟังอยู่แล้ว ธานต้องไป เพราะธานอยู่กับกฎหมายมา 1 ปีธานรู้ ธานเดินไปหาความจริง ธานไม่ได้เดินไปหาเรื่องโกหก ความจริงอยู่ที่ธาน แค่มีข่าวกับอีก 1 คน หรือมีเรื่องกับอีก 1 คน ธานไม่แคร์หรอก เพราะชีวิตธานไม่ได้เหลืออะไรมากมาย ธานอยู่เพื่อคนอื่นมาตลอด ทีนี้ธานขออยู่เพื่อตัวเองบ้าง”
ต่อข้อซักถามที่ว่า รู้สึกอย่างไรกับคำพูดของ “ครูแหม่ม” ที่ว่าเลี้ยงหมาดีกว่าเลี้ยง “นาธาน” เจ้าตัวบอกไม่รู้สึกสะทกสะท้านใดๆ
“ธานไม่รู้สึกอะไร เพราะคนเราเวลาเดือดร้อนหรือเข้าตาจน แล้วถูกคนที่เราคิดว่ารู้สึกปลอดภัย ที่จะไปขอที่หลบใต้ต้นไม้ หรือขอที่อยู่อาศัยที่ปลอดภัยที่สุด แล้วก็ได้รับการโอบอ้อมอารีอย่างดี ที่เรารู้สึกว่าเขาดีกับเรามาก แต่ในขณะเดียวกันความเป็นมนุษย์ของคนไม่ได้เหมือนกันทุกคน ดังนั้นธานรู้สึกว่ามันไม่ได้แตกต่างจากคนที่หวังผลประโยชน์จากความเอื้ออารีนั้น ทุกอย่างมันมีแฝง ดังนั้นที่ธานไปอยู่ที่นั่นก็ไม่ได้รู้สึกอะไร ธานไม่รู้สึกอะไรเลยที่เขาพูดอย่างนี้ ธานรู้สึกว่าความจริงก็อยู่ที่ตัวเขา ฉะนั้นเขาพูดอะไรก็เข้าตัว”
“หนุ่ม กรรชัย” รุกถามต่อถึงคำบอกเล่าของ “ครูแหม่ม” ที่บอกว่า “นาธาน” จะทำทัวร์ และมีการขนซื้อ “เควายเจล” มาเพื่อที่จะใช้ จอมลวงโลกบอกปัด ส่วนเรื่องถูกอีกฝ่ายแฉเป็นกะเทย “นาธาน” ไม่ตอบรับและไม่ปฏิเสธ แต่พูดเป็นนัยให้กลับไปคิดกันเองว่า เขาอยู่ในฐานะอะไรกับ “ครูแหม่ม”

ทีโอทีจูบปาก AIS โรมมิ่งโครงข่าย
ทีโอทียอมเปิดโรมมิ่ง ดาต้า โครงข่าย TOT 3G ให้ลูกค้าเอไอเอสใช้ 5 หมื่นเลขหมาย แลกกับการที่เอไอเอสเปิดให้ลูกค้าทีโอที โรมมิ่งบริการด้านเสียง 2 แสนเลขหมาย 'วรุธ' ยันไม่กระทบ MVNO 5 ราย
นายวรุธ สุวกร กรรมการผู้จัดการใหญ่ บริษัท ทีโอที กล่าวว่า ทีโอทีและบริษัท แอดวานซ์ อินโฟ เซอร์วิส (เอไอเอส) ได้ข้อสรุปในหลักการเกี่ยวกับการโรมมิ่งโครงข่ายระหว่าง 2G ของเอไอเอสกับ TOT 3G เรียบร้อยแล้ว โดยสรุปว่าที โอที จะให้เอไอเอสโรมมิ่งการรับส่งข้อมูล กล้องวงจรปิด (ดาต้า) มายังระบบ TOT 3Gจำนวน 5 หมื่นเลขหมายในขณะที่เอไอเอสจะเปิดให้ทีโอทีโรมมิ่งวอยซ์จำนวน 2แสนเลขหมาย จากเดิมเอไอเอสจำกัดการให้โรมมิ่งของทีโอทีจำนวน 5หมื่นเลขหมาย เนื่องจากทีโอทีไม่สามารถหาข้อสรุปปริมาณการโรมมิ่งดาต้าที่ชัดเจนให้เอไอเอสได้
ทั้งนี้แนวทางดังกล่าวเป็นหลักการเบื้องต้นร่วมกันระหว่างทีโอทีกับเอไอเอส โดยหลังจากนี้ทั้ง 2 บริษัทจะต้องมีการหารือในเรื่องรายละเอียดของสัญญาโรมมิ่งซึ่งคาดว่าสัญญาดังกล่าวจะมีอายุคราวละ 6 เดือน นอกจากนี้ยังอยู่ระหว่างพิจารณาด้านเทคนิคการใช้งานด้วยเพื่อป้องกันไม่เห็น เกิดปัญหาไปกระทบกับการใช้งานลูกค้าของบริษัทที่ทำตลาดแบบMVNO ของทีโอทีทั้ง 5 รายคือ บริษัท สามารถไอ-โมบาย ,บริษัท ล็อกซเล่ย์ ,บริษัทไออีซี ,บริษัท 365 คอมมูนิเคชั่นและบริษัท เอ็ม คอนซัลท์
สำหรับค่าบริการในการโรมมิ่งที่จะคิดกับเอไอเอสเป็นอัตราเดียวกับที่ทีโอทีคิด MVNO ทั้ง 5 รายที่ประมาณเมกกะบิตละ 10 สตางค์ อย่าง ไรก็ตามการที่ทีโอทีเปิดให้เอไอเอสโรมมิ่งดาต้ากับ TOT 3G นั้นเนื่องจากต้องการแก้ปัญหาความสามารถในการรองรับการใช้งานที่ไม่เพียงพอ ของโครงข่ายทั้งสองฝ่ายเพราะที่ผ่านมาลูกค้าเอไอเอสมีการใช้งานดาต้ามากขึ้น จึงมีความต้องการโรมมิ่ง TOT 3G เพื่อรองรับการใช้งานดังกล่าว ในขณะที่ทีโอทีไม่มีโครงข่ายนอกพื้นที่กทม.และปริมณฑล เพื่อให้บริการลูกค้าเช่นกัน
อย่างไรก็ดียอมรับว่าMVNO ทั้ง 5 รายของทีโอที ยังมีความกังวลว่าภายหลังจากที่เอไอเอสโรมมิ่งดาต้าแล้วจะทำให้ความสามารถใน การรองรับการใช้งานของลูกค้ามีไม่พอ แต่ทีโอทีมั่นใจว่าโครงข่ายTOT 3G ทางเทคนิคน่าจะรองรับการใช้งานได้เพียงพอ เพราะการเปิดให้โรมมิ่งดังกล่าวเอไอเอสต้องเสียค่าโรมมิ่งเช่นเดียวกับผู้ ให้บริการ MVNO รายอื่นซึ่งรายได้จากส่วนนี้จะช่วยให้ทีโอทีมีเงินในการขยายโครงข่ายเพื่อ รองรับการใช้งานเพิ่มขึ้น
นายวรุธ กล่าวถึงความคืบหน้าการลงทุนโครงข่าย 3Gทั่วประเทศว่าจะมีการส่งแผนธุรกิจดังกล่าวให้บอร์ดทีโอทีที่มีนายอารีพงศ์ ภู่ชอุ่ม เป็นประธานเพื่อพิจารณาว่าจะต้องการปรับแผนหรือไม่ ก่อนเสนอนายจุติ ไกรกฤษ์ รัฐมนตรีว่าการกระทรวงเทคโนโลยีสารสนเทศและการสื่อสาร (ไอซีที) หลังจากก่อนหน้านี้แผนดังกล่าวได้ทำไว้เสนอ รมว.ไอซีทีคนก่อนเพื่อเสนอคณะรัฐมนตรี แต่รมว.คนเดิมได้พ้นจากเก้าอี้ไปก่อน

นายวรุธ สุวกร กรรมการผู้จัดการใหญ่ บริษัท ทีโอที กล่าวว่า ทีโอทีและบริษัท แอดวานซ์ อินโฟ เซอร์วิส (เอไอเอส) ได้ข้อสรุปในหลักการเกี่ยวกับการโรมมิ่งโครงข่ายระหว่าง 2G ของเอไอเอสกับ TOT 3G เรียบร้อยแล้ว โดยสรุปว่าที โอที จะให้เอไอเอสโรมมิ่งการรับส่งข้อมูล กล้องวงจรปิด (ดาต้า) มายังระบบ TOT 3Gจำนวน 5 หมื่นเลขหมายในขณะที่เอไอเอสจะเปิดให้ทีโอทีโรมมิ่งวอยซ์จำนวน 2แสนเลขหมาย จากเดิมเอไอเอสจำกัดการให้โรมมิ่งของทีโอทีจำนวน 5หมื่นเลขหมาย เนื่องจากทีโอทีไม่สามารถหาข้อสรุปปริมาณการโรมมิ่งดาต้าที่ชัดเจนให้เอไอเอสได้
ทั้งนี้แนวทางดังกล่าวเป็นหลักการเบื้องต้นร่วมกันระหว่างทีโอทีกับเอไอเอส โดยหลังจากนี้ทั้ง 2 บริษัทจะต้องมีการหารือในเรื่องรายละเอียดของสัญญาโรมมิ่งซึ่งคาดว่าสัญญาดังกล่าวจะมีอายุคราวละ 6 เดือน นอกจากนี้ยังอยู่ระหว่างพิจารณาด้านเทคนิคการใช้งานด้วยเพื่อป้องกันไม่เห็น เกิดปัญหาไปกระทบกับการใช้งานลูกค้าของบริษัทที่ทำตลาดแบบMVNO ของทีโอทีทั้ง 5 รายคือ บริษัท สามารถไอ-โมบาย ,บริษัท ล็อกซเล่ย์ ,บริษัทไออีซี ,บริษัท 365 คอมมูนิเคชั่นและบริษัท เอ็ม คอนซัลท์
